Morghew Estate operates this store and website, including all related information, content, features, tools, products, and services to provide you, the customer, with a curated shopping experience (the "Services"). Morghew Estate is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms of Service ("Terms") carefully. By visiting, interacting with, or purchasing from our website, you agree to be bound by these Terms and our Privacy Policy.

SECTION 1 - ACCOUNT & ELIGIBILITY

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence. You agree to provide current, accurate, and complete account, billing, and shipping details for all purchases made at our store.

SECTION 2 - PRODUCTS & DISCLAIMERS

  • Product Descriptions: We make every effort to display the colors and images of our products accurately. All descriptions of products are subject to change at any time without notice at our sole discretion.

  • Potato Usage Disclaimer: Our potatoes are sold for consumption only and are not certified seed potatoes unless explicitly stated. They are not sprayed with sprout-inhibiting chemicals. We accept no liability if you choose to plant them in your garden.

SECTION 3 - ORDERS, PRICES, & PAYMENT

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, or limit any order for any reason. Prices, discounts, and shipping rates are subject to change without notice. Posted prices do not include shipping, handling, or applicable taxes unless expressly stated.

SECTION 4 - SHIPPING, DELIVERY, & LOG TERMS

  • Standard Mail Order Produce: Standard delivery takes 2 to 3 working days after your order is placed. Produce is shipped packed unwashed to preserve shelf life. Delivery is completed by external couriers (such as APC or DPD). You must specify delivery preferences (e.g., leave with a neighbor) in the Order Notes at checkout.

  • Address Accuracy: You must ensure your delivery address and postcode are accurate. We reserve the right to adjust delivery charges or cancel orders if incorrect details are entered or if an address falls within a restricted delivery area.

  • Wild Game Postage: Wild game is delivered frozen via a next-day delivery service. Orders placed on Friday, Saturday, or Sunday will be dispatched on the next working day. Packaging maintains safe temperatures for up to 48 hours from dispatch. You must be available to receive the delivery or provide clear safe-place instructions at checkout. We accept no claims for deliveries within the 48-hour window or for parcels rescheduled, refused, or returned by the customer.

  • Wild Garlic Postage: Postage within mainland UK is fixed at £5 for up to 1kg of Wild Garlic.

  • Log Delivery Charges & Access: Delivery for local firewood is calculated per mile from Morghew Park Estate (TN30 7LR): £1.50/mile (0–8 miles), £2/mile (9–15 miles), and £3/mile (16+ miles) for one-way tipping only. Log stacking services are not provided. Customers must provide a clear, unobstructed area for truck reversing and tipping (minimum 2 car lengths).

SECTION 5 - REFUNDS & RETURNS

All purchases are subject to return or replacement solely in accordance with our Return & Refund Policy. You must notify us of any damaged or missing items within 3 days of receipt.

SECTION 6 - PROHIBITED USES & AUTOMATED AGENTS

In addition to standard prohibited uses outlined in these Terms (such as unlawful activity, harassment, or transmitting malware), you may not use automated devices, scrapers, AI tools, or semi-autonomous software Agents to access or interact with the Services without identifying the Agent string ("Agent/[agent name]") in HTTP/HTTPS requests.

SECTION 7 - RELATIONSHIP WITH SHOPIFY

Morghew Estate is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Morghew Estate. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Morghew Estate.

SECTION 8 - INTELLECTUAL PROPERTY & THIRD-PARTY LINKS

All content on this site—including text, images, logos, and graphics—is owned by or licensed to Morghew Estate. You may not reproduce, distribute, or exploit any site content without our prior written consent. We are not responsible for examining third-party content or links embedded in our store.

SECTION 9 - DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Except as expressly stated, the Services and all products are provided 'as is' and 'as available'. To the maximum extent permitted by applicable law, Morghew Estate shall not be liable for direct, indirect, or consequential damages resulting from product use or delivery delays beyond our reasonable control.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
